1. Intellectual Property & Trademarks

• All product names, logos, brands, and trademarks featured on Swappy are the property of their respective owners.
• Use of these names, logos, and trademarks on Swappy is strictly for the purpose of identifying genuine products made available for swap or subscription.
• Swappy has no affiliation, sponsorship, endorsement, or official partnership with any brand, manufacturer, or intellectual property holder, unless expressly stated in writing.
• Any reference to third-party trademarks does not imply any association, authorization, or approval by the trademark owners.

2. Product Authenticity & Condition

• Swappy facilitates the circulation of pre-owned toys. All items are genuine and legally acquired, but may be used, refurbished, or previously owned.
• Swappy undertakes reasonable checks for cleanliness, usability, and condition but cannot guarantee that every product is free from wear, defects, or risks.
• Products are provided “as is” and “as available”, without any express or implied warranty of quality, durability, or merchantability.

3. Safety & Customer Responsibility

• Parents and guardians are solely responsible for inspecting toys received via Swappy before allowing use by children.
• Customers must ensure toys are age-appropriate, safe, and used under adult supervision.
• Swappy shall not be liable for any injury, accident, allergic reaction, choking hazard, or other harm resulting from use or misuse of any product.
• Customers accept full responsibility for safe handling and use of all products.

4. Limitation of Liability

• Swappy is a facilitator of toy subscription and swapping services. It is not a manufacturer, distributor, or official reseller of any brand.
• To the maximum extent permitted by law, Swappy disclaims all warranties (express or implied), including fitness for purpose, durability, and merchantability.
• Swappy, its affiliates, directors, employees, and partners shall not be held liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from product use, including but not limited to injury, loss, or property damage.

5. Intellectual Property Restrictions

• Customers may not reproduce, redistribute, or resell toys, brand logos, or product imagery obtained through Swappy for commercial gain.
• Any unauthorized use of intellectual property remains the sole responsibility of the customer.

6. Customer Agreement

• Toys provided are pre-owned and circulated.
• They will inspect and approve all toys before use.
• They accept that Swappy bears no liability for product condition, brand ownership disputes, or any harm caused through use.
• They release Swappy from any and all claims arising from the use, misuse, or condition of the products.

7. Default & Non-Payment Policy

• All subscriptions are prepaid. Payment must be completed before toys are delivered.
• If a renewal payment fails, the account will be placed on hold. Borrowed toys must be returned within 7 days of the plan’s expiry.
• If toys are not returned within this grace period, Swappy reserves the right to charge the full retail value of unreturned toys to the customer’s saved payment method.
• Customers will receive payment failure notifications and reminders before enforcement actions are taken.
